54 Dean Street S.n.c. ("54 Dean Street") operates the website with the domain names https://www.54deanstreet.com/ and https://www.54deanstreet.it/ (“Website”) which allows people and companies (“Customers“ or, individually, “Customer”) to purchase fly fishing and fly tying products, and similar items (collectively "Products").

By registering as user of the Website, between the Customer and 54 Dean Street is a contract to use the services offered by 54 Dean Street through the Website ("Terms & Conditions of Use Agreement") governed by the following provisions. Before the contract is signed and before that Customers can place orders through the Web Site maintained by 54 Dean Street, you must have taken note and accepted the following conditions. 54 Dean Street will communicate in an appropriate manner any amendments to these terms.

54 Dean Street offers through its Web Site a platform that enables the conclusion of contracts of sale between 54 Dean Street itself and its Customers. Customers of 54 Dean Street can only be people capable of acting with a minimum age of 18 years old. The services provided by 54 Dean Street trough the Website, for the Customer himself, are free. During recording and execution of orders, the Customer is required to enter data in accordance with the truth.

54 Dean Street and the Customer immediately regulate the conditions of sale, including the delivery of the object of sale, and terms of payment. Between 54 Dean Street and Customer apply the rules of law in respect of defects in the goods and warranty against eviction. Each item offered for sale on the Website may be purchased by credit card or bank transfer. Payments by credit card will be managed by 54 Dean Street through PayPal. The login information must be kept confidential and the Customer shall be responsible for any misuse of his credit card. The Customer shall immediately notify 54 Dean Street about any abuse of his credit card or Paypal account. 54 Dean Street will not be required to carry out checks on the legal and regular use of the credit card.

The order made by the Customer will constitute a binding offer. 54 Dean Street has no responsibility in case of, exceptionally, items who still exist on the Website, are no longer available at the time of the Customer order. A 54 Dean Street responsibility towards the Customer, regardless of its legal basis, will exist only in the following cases:

a) 54 Dean Street will be liable under current rules, if the Customer were to claim compensation for damages due to negligence, recklessness, carelessness, even of employees and associates.

b) In case it can not be charged to 54 Dean Street any malicious activity, the responsibility of itself shall be limited to typical and foreseeable damages. 54 Dean Street shall not be liable for consequential damages, lost profits or loss of business opportunity.

c) Is without prejudice the different responsibility of 54 Dean Street for personal injury or by product.

The data transmitted by the Customer via the Website will be treated by 54 Dean Street in an automated mode, in a confidential manner and in compliance with the rules on the processing of personal data, pursuant to Legislative the Decree D.Lgs. 101/2018 and to the General Data Protection Regulation UE 2016/679 (GDPR - Regolamento Generale sulla Protezione Dati), in force in all European Union countries from 25 May 2018.

54 Dean Street or the Customer may at any time terminate this Use Agreement. All actions for damages arising from use of the Website of 54 Dean Street or conditions contained in this agreement, shall be barred within one year from the date they occurred, and that regardless of any legal terms shorter.

The Terms & Conditions of Use Agreement and any relationship between 54 Dean Street and the Customer will be subject to the law of the Italian Republic. In case of disputes concerning or related to the The Terms & Conditions of Use Agreement, its terms or, in general, the use of the Web Site of 54 Dean Street, will be the competent exclusively the Court of Bologna, Italy.
